Business texting (SMS) program terms

These Messaging Terms govern the KitchenRush business texting (SMS) program operated by Alis Industries (“KitchenRush,” “we,” or “us”) on behalf of independent restaurants (each, a “Restaurant”). A Restaurant uses KitchenRush to send text messages from its own dedicated, carrier-registered number to its own customers. By enabling a texting line, the Restaurant agrees to these terms; by opting in to texts from a Restaurant, a customer agrees to receive them on the terms below.
1. Program description
Restaurants use KitchenRush to send order updates, reservation and catering confirmations, replies to customer inquiries, and—where the customer has opted in—promotional offers. Messages are sent only from a number registered to that Restaurant’s business identity under the carrier A2P 10DLC framework.
2. Consent and opt-in
Customers receive texts only after providing consent—for example, by giving their mobile number for an order, reservation, or catering request, or by opting in to updates and offers. Marketing or promotional texts are sent only with the customer’s prior express written consent, which is never required as a condition of any purchase. The Restaurant is responsible for obtaining and honoring consent for its own customers.
3. Message frequency
Message frequency varies based on the customer’s orders, reservations, and interactions with the Restaurant.
4. Message and data rates
Message and data rates may apply. Charges depend on the customer’s mobile carrier and plan. KitchenRush and the Restaurant do not charge customers to receive texts.
5. Opt-out and help
Customers can opt out at any time by replying STOP to any message. After replying STOP, the customer receives a confirmation and no further texts from that Restaurant’s number, unless they opt back in by replying START. For help, customers can reply HELP or contact the Restaurant directly.
6. Carriers and delivery
Supported carriers include major U.S. carriers. Carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier conditions and is not guaranteed.
7. Restaurant responsibilities and verification
To enable a texting line, the Restaurant submits accurate business information for carrier verification (A2P 10DLC brand and campaign registration), and authorizes KitchenRush to submit that information to its messaging provider and the carrier registry on the Restaurant’s behalf. The Restaurant confirms the information is accurate and that it will text only customers who have opted in, will honor opt-out requests, and will comply with applicable law including the Telephone Consumer Protection Act (TCPA) and carrier requirements. A one-time carrier registration fee and ongoing messaging charges may be billed to the Restaurant’s KitchenRush subscription.
8. Privacy
Mobile information and consent are used to deliver this messaging program and are not sold or shared with third parties for their own marketing. Message content and phone numbers are processed to send, receive, and support these texts. See the KitchenRush Privacy Policy for details.
9. Changes
We may update these Messaging Terms from time to time. Continued use of the texting program after an update constitutes acceptance of the revised terms.
